Effect this measure will have on costs and revenues of state government.
This bill establishes a statute of limitations for claims for unjust arrest and wrongful incarceration that are filed in the Legislative Claims Commission under West Virginia Code 14-2-13a.
This bill also establishes a time period during which a claimant may receive crime victim compensation benefits under West Virginia Code 14-2A-14a, a new provision to the statute. Claims will be considered closed and no longer eligible for benefits once the available benefits are expired or ten years after the date the claim was filed.
These provisions do not have a fiscal impact on the Legislative Claims Commission and the Crime Victims Compensation Fund.
