Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to require the State Department of Education to develop a pilot program to provide mental and behavioral health services as an alternative to suspending students for disruptive behaviors. The Department currently has the following initiatives for school-based services. 1) The Department’s Bureau for Behavioral Health currently funds Expanded School-based Mental Health grant programs in 56 schools and is currently in the process of awarding funding for 20 additional sites. 2) The Department’s Bureau for Behavioral Health funds 18 schools in Kanawha County through a grant with WV Department of Education. This funding was a one-year federal State Opioid Response grant that was extended for an additional year due to COVID delays. Based on the current programs in place, the Department estimates no fiscal impact. If the bill requires additional pilot sites, in addition to those currently operating, there would be additional cost, per Department of Education (DOE) fiscal note. Currently DHHR covers $30K per site and DOE covers $10K per site.

Memorandum


The bill requires education to bill and collect payment for services rendered from insurance or DHHR in case of court order. Therefore, the Department could be court ordered to open Youth Services (YS) cases to pay for these services in conjunction with a diversion or disposition in a juvenile case and pay for these services in both YS and Child Protective Services (CPS) cases when the child is having behavior difficulties in school. If the child behavioral issues do not result in a court ordered removal from the home, any additional provision of service costs would be funded by state and not federal funds.
