Effect this measure will have on costs and revenues of state government.


This proposed legislation, in its current form, does not have any fiscal impact on the WVDE; however, it will have fiscal impact on the various county boards of education. Specifically, this bill establishes two requirements: 1) All classes of personnel and teachers hired for employment in K-12 schools pass a drug test prior to beginning employment; and, 2) 10% of all employees and volunteers are subject to random drug testing each year.

Explanation of above estimates (including long-range effect):


This legislation, in its current form, does not have any fiscal impact on the WVDE; however, it will have fiscal impact on the various county boards of education. To assist in estimating the potential costs of enacting this legislation, the WVDE has identified 37,912.757 professional & service employees in K-12 schools; therefore, approximately 3,791 employees would be randomly drug tested each year. The WVDE reached out to some of the counties in which the county board has implemented drug testing policies and found that the approximate costs of the drug testing in those counties is between $30 to $55. Please note that the WVDE lacks the data necessary to estimate how many athletic coaches or volunteers would be subjected to the drug testing requirements established in this proposed legislation; therefore, an allowance for those persons is not included in this fiscal note.
