The bill creates the Protecting Children from Illegal Vapes Act.
Further the bill defines terms; gives the WV Alcohol Beverage Control Administration regulatory authority; requires a license to sell, distribute, or offer vapor products in this state; creates a product registry; restricts sales; permits inspections and enforcement; creates administrative ($1,000 fine) and criminal penalties ($5,000 and/or 90 days in jail); permits rulemaking; preempts local ordinances; and sets an effective date.
A vapor product is defined as a nicotine-based product.
This bill would increase the costs of state government in order to license, regulate, register and enforce the law on vapor products.
Note, the WVABCA does not currently regulate or tax vapor products.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. This bill would increase the costs of state government in order to license, regulate, register and enforce the law on vapor products but the bill does not set license fees, registration fees or other funds dedicated to perform the requirements of the statute.
