Memorandum
House Bill 5365, if enacted, would update the authority of the Public Employees Insurance Agency (PEIA) and permit the Insurance Commissioner certain authority over the actions of PEIA's pharmacy benefit managers.
HB5365 would have little impact on the WV Offices of the Insurance Commissioner (OIC) considering the OIC currently regulates pharmacy benefit managers and the bill solely adds OIC oversight of PEIA's pharmacy benefit managers.
As this bill applies to PEIA, it is recommended that PEIA be consulted regarding the fiscal impact to that program.
