Effect this measure will have on costs and revenues of state government.
This bill proposes to close the Supreme Court of Appeals' Parent Education Fund (Fund # 1757) created under W. Va. Code §48-9-104; to transfer the unexpended balance in the Parent Education Fund ($274,271.36) to the Supreme Court of Appeals' Family Court Fund (Fund # 1763) created under W. Va. Code §51-2A-22; and to redirect future revenues from parent education class fees under W. Va. Code §48-9-104 and civil penalties for enforcement of parenting plans under W. Va. Code §48-9-501 to the Family Court Fund. Amendment of this bill and an accompanying supplemental appropriation may be needed to accomplish the Court's intent of transferring the unexpended balance in the Parent Education Fund to the Family Court Fund. In recent years, expenditures from the Parent Education Fund have not kept up with revenue into the fund due to decreased cost of delivery of online parent education classes. This legislation and accompanying supplemental appropriation will allow the Supreme Court of Appeals to defray the costs of family courts, for example, reimbursing counties for family court space pursuant to W. Va. Code §51-2A-20. Because the intent does not create new costs or revenue, but simply redirects monies from one of the Supreme Court of Appeals' special revenue funds to another of the Supreme Court of Appeals' special revenue funds, there is no fiscal impact.
