Effect this measure will have on costs and revenues of state government.


House Bill 5470, if enacted, would require pharmacy benefits managers to include any cost sharing amounts paid by the insured or another person when calculating the insured's contribution to any cost sharing requirement; applying certain annual limitation on cost sharing to all health plans issued in the state; and preventing insurers, pharmacy benefit managers and third party administrators from changing the terms of health plan coverage based on the availability or amount of financial assistance available for a prescription drug. Memorandum


House Bill 5470, if enacted, would require pharmacy benefits managers to include any cost sharing amounts paid by the insured or another person when calculating the insured's contribution to any cost sharing requirement; applying certain annual limitation on cost sharing to all health plans issued in the state; and preventing insurers, pharmacy benefit managers and third party administrators from changing the terms of health plan coverage based on the availability or amount of financial assistance available for a prescription drug. HB5470 would have no fiscal impact on revenues, expenses or operations of the WV Offices of the Insurance Commissioner (OIC).
