Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The offenses that are being enhanced by this proposed legislation, make up a significant portion of the current WV Division of Corrections population (8% or about 550 inmates as of June 30, 2015). In addition, the enhancements are significant, for example changing the minimum sentence for a 1 to 15 year sentence to 10 to 30 years.
To further that example, the minimum cost to the State of West Virginia to incarcerate the offender for one year is $28,369 (average annual cost per year in FY 2015), that cost would change to a minimum of $283,690 to incarcerate that offender for 10 years.
In addition, the bill also proposed additional enhancements for offenders who have had previous incarcerations for similar crimes.
Finally, the offender population referenced in the proposed bill is large enough that if minimum lengths of stay are increased, the State would have to consider the acquisition of additional bed space.
Although it is difficult to calculate exactly, the fiscal impact of this bill would be very significant and beyond the ability of the WVDOC to with stain without additional appropriations.
