Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The following is provided with respect to the proposed Senate Bill 348 which indicates it is intended to prohibit local authorities from allowing parking along US and primary state highways when doing so reduces flow of traffic to less than one lane of traffic moving in each direction and requiring DOH to erect signage.
• It appears that the proposed bill would require signage along all US and WV routes regardless of whether parking is allowed or not. This would be a very burdensome and labor-intensive requirement to meet. There is no MUTCD standard signing that denotes unrestricted parking along a corridor. Standard parking signage either informs what restrictions are in place (times of day, duration limits, pay requirement, etc.) or prohibits parking all together. The standard practice is to only install signage where restrictions exist.
• Fiscal Note Detail shown below assumes roughly 5000 miles of US and WV routes, if the intent is to sign all locations identifying whether parking is allowed or prohibited. Assume that it is obvious to a driver that parking would not be permitted (no reasonable shoulder exists) on 75% of the routes leaving 1250 miles for signing. Estimate signing at 500’ intervals (which is a significantly greater interval than we would typically use for No Parking signing) at $200/sign installed including labor, materials and equipment. Assume 10% completion for FY 2017, 25% completion for FY 18. While we would look for ways to eliminate the overall number of signs to comply, the following is illustrative of what would be required with the current proposal as written.

Memorandum
• DOH already coordinates with local authorities, to appropriately regulate parking along designated portions of state-maintained routes within their respective boundaries. This process is in accordance with subsection (b) of this article.
• As we understand it the new language seems to address the specific situation of parking on state routes that restricts flow to less than one-lane each direction, which local authorities are already prohibited from permitting according to subsection (b).
