Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. In order to complete this fiscal note, data was requested from the 511 Traffic Management Center regarding planned closure information provided to them for dissemination through the 511 applications for work that met the criteria proposed by the bill amendment. Based on one year of data, the TMC identified 25 such projects over a one-year period. Since only one year was sampled, 20% was added to this qty for the purposes of this note to create a reasonably conservative estimate. The fiscal note assumes that 4 electronic changeable message sign boards are currently deployed for such projects for 2 weeks prior to the closure. Thus, the note accounts for the cost for an additional 16 days. The note also assumes this requiring the start of the project to begin 16 days earlier and estimates the administrative costs for such.

Explanation of above estimates (including long-range effect):


Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. This note is based on the assumption that there will be 30 projects per year involving a road closure for more than 30 days and a detour greater than 1 mile in length. This note also assumes that electronic changeable message sign trailers would meet the signing requirement. Based on historical average bid pricing from DOH projects over three years, the cost per day per CMS board is $83.71. Assuming that 4 CMS boards are utilized per project, and that such CMS boards are already deployed for this purpose for all projects involving a road closure for a period of 2 weeks prior to the road closure, the additional cost is estimated at $160,713.60 in order to deploy the CMS boards 16 days earlier than is typically done. It is also assumed for this fiscal note that deployment of the message boards for an additional 16 days than what is typical will require such projects to be extended by 16 additional days. This note applies a $650 per day additional administrative cost per project day. This value is derived from Table 108.7.1 of the WVDOH Standard Specifications, which specifies liquidated damage penalties for Contractor delays, and is intended to recapture administrative costs incurred by the WVDOH for project delays on the part of the Contractor. The value used is intended specifically for projects more than $500,000 up to and including $2,000,000 in value. The additional administrative costs associated with this are therefore estimated to be $312,000. This results in a total annual cost of $472,713.60. This is the cost reflected for FY 2025 and full implementation FY2024 Estimated total cost would be preparing legislative rule and contract bid documents.

Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form. This note does not include cost calculations for closures longer than 30 days that are implemented on an emergency basis as a result of unforeseen catastrophic events. It is obviously assumed that the requirements proposed would not apply under such circumstances. It is routine practice for press releases to be issued in advance of significant projects that will affect drivers, including closures of the type targeted by the proposed amendment. Notifications are also released by the traffic management center (TMC). The TMC receives daily work reports from the Districts advising of work that is going on in the District on the roadways and will make that information available on the 511 site, will send out text or email notifications to individuals who have subscribed to receive the notifications, and will post them to the 511 X (Twitter) site. In addition to press releases that are issued in advance of significant closures, public meetings are held to inform and receive input from the public. The DOH also has concern for the safety of the workforce as a result of this proposed legislation. Multiple studies prove that drivers become cognitively disengaged when road signs are erected and their is no active construction. As a result of this proposed legislation, road signs would be erected 30 days prior to the anticipated (Com.Sub) start date. The concern of the DOH is that when construction does begin, drivers will not adhere to the posted speed limit, placing workers in added danger.
