Memorandum


1.“This bill may have a limited fiscal impact on County Prosecutor’s offices and/or the Attorney General’s office but there will be no impact on this agency’s revenue or expenditures and even where Special Prosecutors, appointed by this agency under WV Code §7-4-6(d)(1), may be prosecuting a death penalty case those Special Prosecutors are appointed from the ranks of the County Prosecutors’ offices.” 2.“Given that the Prosecutors Institute is statutorily mandated to give technical support to local prosecutors upon request[WV Code §7-4-6(d)(3)], if an employee of this agency were to consult with or assist a local prosecutor or special prosecutor with respect to a death penalty case it would not increase or decrease revenues or expenses of the agency”
