Effect this measure will have on costs and revenues of state government.
There is no estimated cost to the State for the proposed legislation. It is the WVDE's understanding that this bill would simply change the current methodology utilized to allocate out-of-state placements to specific school districts in the calculation and distribution of the state special education appropriation. Instead of assigning the cost of out-of-state placements to specific counties, the legislation would require the WVDE to pay for out of state placement costs off the top and allocate the remaining appropriated funds among the county boards of education.

Explanation of above estimates (including long-range effect):
Although there is no cost to the State for the proposed legislation, the required change in allocation methodology would have varying impacts on the county boards of education. County boards of education that are currently charged for a significant number of out-of-state placements would benefit since their state special education allocation would no longer be directly reduced for the cost paid by the WVDE for those students. County boards of education that are not currently charged with specific out-of-state students would experience a reduction in their state special education allocation because the available funding would be reduced by the statewide cost for the out-of-state placements.
Memorandum
Although the WVDE believes the intent of the legislation is to change the current methodology utilized to allocate out-of-state placements to specific school districts by requiring the WVDE to pay for out-of-state placement costs off the top and to allocate the remaining appropriated funds among the county boards of education, the proposed language is somewhat unclear and could be subject to interpretation. The WVDE recommends clarifying the language so there is no question as to what is intended.
