Summarize in a clear and concise manner what impact this measure will have on costs and revenues of state government. There is no additional cost to the State for this proposed legislation since the allowances under the Public School Support Plan (PSSP) are not being increased. Consequently, the total estimated cost would have to be borne by the county boards of education. The estimated cost to the county boards of education for the proposed legislation is $28,032,445.

Explanation of above estimates (including long-range effect):


Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. Utilizing current design capacity of schools and an average of 40 students per stall, as required by current plumbing code, it is estimated that approximately 11,929 stalls would need to be installed throughout the state as a result of this proposed legislation. Of that total, approximately 10% of those stalls will be required to be ADA compliant. Using estimated per-stall stall costs of $2,300 and $2,800 for non-ADA and ADA compliant stalls, respectively, the estimated cost of this proposed legislation is $ 28,032,445.



Memorandum


Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form. The WVDE, in its normal operations, does not track the number of toilet stalls in public schools in the state nor the privacy provided by each stall. Therefore, certain assumptions and estimations were utilized to calculate the provided data. The WVDE does have the design capacity for each public school in the state, and this number represents the maximum number of students that each school can pragmatically have in their building. Estimating the number of stalls that will need to be provided was done by dividing each school’s design capacity by the number of stalls per person that the applicable plumbing code requires. The ratio for male and female stalls is different, so an average stall per student number of 40 was used in the calculation. Another variable factored into the analysis is the need to provide more costly ADA-accessible stalls, which were provided at a rate of 10% of the overall required stalls number. Additionally, it was assumed that no schools in the state currently provde privacy at the suggested level. Applying this process to all county schools, multi-county technical centers, and the WV Schools for the Deaf and the Blind, there would be an approximate need for 11,929 new toilet stalls in the state, for a total cost of approximately $28,032,445. A renovation such as this does have concerns or additional work that could be necessary to meet other code requirements. 1. The additional height necessary to provide privacy may require additional ventilation to maintain the correct amount of airflow in the bathroom. This estimate does not provide a cost for that work, as each situation will be different and presents many unknown variables. 2. The additional height may require the modification of the sprinkler system to maintain the required clearance. 3. Modifying the existing toilet partitions may require the toilet to be brought up to current codes, and as such, the bathroom may have fewer stalls due to additional stall widths that might be needed. 4. This provided number does not account for any changes in toilet accessories required and what is available in the existing toilet for reuse. 5. With the toilet partitions going very close to the floor for privacy, floor drains might have to be relocated to maintain usability. NOTE: This cost was calculated using prices available at the time of this analysis. More refined quotes could increase or decrease this estimated cost.
