Memorandum
Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form.
The DOH has performed a preliminary review of the proposed bill and has not found this to be contrary to providing effective control; however, we have also requested that the Federal Highway Administration Division office provide comments, but have not received them at this time. We offer the following comments:
We are uncertain what the intent is with respect to licensure and number of permits. Licenses are issued based on the number of permits held/desired. For an entity with up to 20 permits a license fee of $125 is assessed for an entity with 21 permits or more the license fee is $1,000. This needs to be clarified and we would recommend that a "no-fee" license issued to a nonprofit organization be limited to 2 permits.
There are two types of permits that can be issued: static or changeable message/LED. It is unclear what is intended but it is recommended that the nonprofit organization "no-fee" permit be limited to static signs.
From a cursory review of outdoor advertising license holders, there are currently 6 license holders that appear to be nonprofit organizations.
There are a total of 13 permits with 9 being static and 4 being changeable message/LED which appear to be issued to nonprofit organizations.
