This bill proposes to create a new section (ยง5A-3-10f) that would prohibit contracts being awarded to vendors that require certain vaccinations for their employees, specifically the COVID-19 vaccine, as a condition of their employment.
This change would require the Purchasing Division to reject a low bidder in favor of a higher bid if the low bidder mandated vaccination. This would increase expenses for the agency seeking the contract.
It would also prohibit existing contracts from being renewed if the current vendor mandated vaccination. The resultant rebid would add unexpected time and expense for the agency.

Explanation of above estimates (including long-range effect):
As noted above, the bill will require that the lowest cost bid be rejected in favor of a higher cost bid. It would also prohibit existing contracts from being renewed if the current vendor mandated vaccination. This will increase expenses incurred by the State in obtaining commodities and services, but it is not possible to estimate the extent of that impact at this time.
Memorandum
The bill likely does not accomplish its original intent as its placement of the mandate in Chapter 5A, Article 3, means that all agencies exempted from Purchasing Division oversight will not be required to comply when awarding contracts.
