Effect this measure will have on costs and revenues of state government.
Due to the fact that State Code has previously not permitted this type of facility, the legislation will require the West Virginia Department of Education to develop a licensing, certification and/or approval process for school planning to implement special education services in compliance with the Individuals with Disabilities Education Act, 2004 (IDEA), along with the WVBE required policy to implement IDEA, Policy 2419, the Regulations for the Education of Students with Exceptionalities.
