Explanation of above estimates (including long-range effect):


There is no additional cost to the state as a result of the proposed legislation. The proposed legislation incorporates procedural changes to existing statute. The proposed legislation allows for a school administrator designee other than the principal to act as the custodian of recordings created by cameras in self-contained special education classrooms as set forth in W. Va. Code ยง18-20-11 and addresses parameters for the retention, viewing, and release of video footage created by these cameras. The largest fiscal impact of the proposed legislation would be for camera systems installed or replaced after April 1, 2022 to have the ability to retain video footage for at least 365 days. None of the parameters included in the proposed legislation creates an additional cost to the state. Consequently there would be a cost to county boards of education to increase the storage capacity of camera systems to 365 days. However, such an estimate is indeterminable as there are numerous factors affecting cost and frequency of device replacement in each county. The most cost effective strategy for county boards of education to implement the proposed legislation is to replace current systems with a camera with an internal storage capacity to meet the 365 day requirement. There is an estimated cost per unit of $2,840 for video cameras capable of meeting the 365 storage requirement. Due to the varying useful lives of current systems as well as other outstanding factors, an annual replacement cost is indeterminable at this time.
