HB4746 is proposed to amend and add a new section to require sharps containers in all state buildings and facilities where the public is allowed and at welcome centers and rest areas on public highways.
This program will increase expenses for the West Virginia Division of Highways (DOH) at our facilities. It will provide a service that will require special monitoring that our personnel are not trained to perform. DOH will be required to contract for containers and appropriate disposal of containers.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. The costs are to provide services for all DOH public accessible facilities as follows:
69 - Welcome Centers and Rest Areas both men and woman facilities
524 - DOH Building Facilities (state wide)

Please identify any areas of vagueness, technical defects, reasons a bill would not have a fiscal impact, and/or any special issues not captured elsewhere on this form.
It is the intent to provide this service at all DOH public accessible facilities.
However, the bill indicates moneys for this program should be expended from the highway litter control fund. It should be noted there is not a separate fund for highway litter control. For every new vehicle registration or registration renewal, a fee of $1 is charged and then deposited into the State Road Fund.
The Division of Highways annual operating budget includes an appropriation line specific to Highway Litter Control activities, with a legislatively approved spending authority amount. This is to be used for highway litter pickup, Adopt a Highway related costs and other services such as the removal of animal carcasses. The current amount of spending authority would not be adequate to these cover costs plus the additional expenses proposed in this bill. In addition, the revenue collected may not be sufficient to cover the existing and proposed increased expenses. The overall impact could result in having to cover these costs from other State Road Fund collections therefore reducing the amount of funds available for other road construction and maintenance activities.
