Memorandum
The bill's first section would imbue the Attorney General with discretion to pursue an affirmative court declaration that this bill's provisions are constitutional after an event that would allow states to regulate abortion, such as the U.S. Supreme Court overruling Roe v. Wade. In fact, the U.S. Supreme Court did overrule Roe v. Wade in June 2022, and the Legislature then passed the Unborn Child Protection Act (HB 302) in September 2022. Consequently, the possible action by the Attorney General allowed under this bill is unnecessary and expected to have no fiscal impact.
