Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The proposed legislation creates the Safety in Schools Fund, which is to derive its assets from remainder American Rescue Plan Act (ARPA) and Coronavirus State and Local Fiscal Recovery Funds (SLFRF) funds as appropriated in accordance with W. Va. Code §18-9D-1 et seq., as well as the proceeds of any gifts, grants, contributions, or other moneys accruing to the state which are specifically designated for inclusion in this fund. The West Virginia Department of Education (Department) has received no funds appropriated in accordance with W. Va. Code §18-9D-1 et seq., which is the section of statute creating and governing the School Building Authority (SBA). As a result, the Department cannot estimate the amount of remainder ARPA and SLFRF funds that may or may not be available for appropriation to the Safety in Schools Fund. The Department also has no available data on which to base an estimate for proceeds of gifts, grants, contributions, or other moneys accruing to the state which are specifically designated for inclusion in this fund. Therefore, the Department recommends that the Legislature reach out to the SBA for this estimate.

Explanation of above estimates (including long-range effect):
