Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


When Division of Corrections and Rehabilitation drafted, bid, and awarded the new food service contract, the new Act had not been passed/implemented and/or our Agency was not aware of said Act. Therefore, no language was placed in the bid mandating the vendor to comply with said Act. However, our Agency had conversations with Department of Agriculture as well as some local producers. We explained to them we must have committed quantities of produce that is on our menus as well as fixed annual pricing. In addition, we are unable to purchase live cows/hogs/chickens for slaughtering due to unavailability of slaughtering/processing services in our state. We requested to purchased finished, packaged meat, but was told this is not possible. Due to the Agency budget and assuring proper food and food quantities are in place at our facilities, we have not been able to receive the commitments required. Our Agency produces farm grown vegetables at many facilities which are used for our inmate menus, as well as donating to local community shelters and aging programs. If an in-state supplier could be located there is a chance that prices could greatly increased as the vendor would not be able to utilize their Companies nationwide buying power to get the food and the price per plate would almost surely increase.

At this point with uncertainties of vendor availability, inflation and CPI increases there would be no way to accurately project the possible cost increase at this time.



Memorandum


There is a substantial problem with this bill and its affect on Division of Corrections and Rehabilitations ability to properly feed inmates/residents if held to this standard. This is due to the fact of the massive amount of products that are needed at these locations and local vendors potentially not being able to meet the committments required to feed our inmates/residents
