The purpose of proposed HB3114 is to eliminate the payment of severance pay for WVDOT employees who violate the WV Department of Transportation's (DOT) Drug and Alcohol Testing Policy or refuse to take a drug screening within their six-month probationary period.

Please explain increases and decreases in personal services, current expenses, repairs and alterations, assets, other costs and revenues, including assumptions and data sources and delineation between start-up and ongoing costs. Please also include a long-range schedule of costs and revenues if fiscal impact is expected to vary in future years. Passage of HB3114 can only decrease costs for state government. In FY23, there were two (2) employees dismissed for violation of the WVDOT’s Drug and Alcohol Testing Policy who received severance pay. Under current code (§29-6-10) both employees received the maximum payout of 88 hours (15-days).
