Explanation of above estimates (including long-range effect):


This proposed legislation creates a new test score reporting category for students who transfer between schools and students who do not attend schools on a regular basis. It does not appear to affect the administration or reporting of student results derived from statewide summative assessments.



Memorandum


Please note, this proposed legislation is similar to already existing Federal law known as the Every Student Achieves Act (ESEA) which requires states to report student enrollment and attendance data as an indicator for school success with its assessment results. The federal requirement to include a student’s assessment data in a school report is based on enrollment for a Full Academic Year (FAY), currently WV’s FAY percentage is 75% which equates to 135 of 180 instructional days. Since attendance is a required indicator for ESEA, chronically absent students are defined as students absent for more than 10% of the enrollment period (18 of 180 instructional days); therefore, schools are expected to specifically address chronic absenteeism as well as implement ways to improve student attendance overall. Schools receive both Federal and State monies to assist with addressing and improving attendance. The WVDE has the ability to report the data required by the provisions of this bill but such reporting cannot be submitted in lieu of the already established federal reporting requirements to the US Department of Education.
