Memorandum
This legislation, in its current form, does not have any fiscal impact on the WVDE. Please note that 126CSR16/State BOE Policy 2419 in Chapter 6, §4(B) addresses adequate staffing and limits the number of special education students to not more than 12 students per period, but some classes may have only four students per period depending on the level of student need. Currently, LEA’s are permitted to submit waivers, but special education teachers are not entitled to additional compensation for accepting more students upon approval of a waiver under current law. In conclusion, because the current WVBOE Policy establishes a much lower threshold for classrooms with special education students than provided in the current teacher per pupil law which limits the number of students to 20 to 25 students, it is unlikely that a special education teacher would exceed the statutory limit since it would be a violation of State Board policy.
