With the information that is in SB 596 I do not feel like I have the information required to accurately project the fiscal impact on the revenue side of the DCR Regional Jail Fund.

Memorandum


One of the concerns is that the calculation for pro rata proportion of inmate days based solely on the county census may not be a proper way to determine the number of days allotted to each county. Examples: * Avg. days billed last 3 years Barbour County *(10,294) K(2)calculation (15,465 x.52 = 8,042) Kanawha County *(73,273) K(2) calculation (180,745 x.52 = 93,987) Randolph County *(28,477) K(2) calculation (27,932 x .52 = 14,525) Webster County *(7,325) K(2) calculation (8,378 x .52 = 4357) Another concern is that k(3) discusses it " per inmate whose period of incarceration is 80% less than the base number of pro rata days resulting from the calculation in K(2) So on K(3) for any inmate whose period is 80% less would equate to the following: Barbour = 6,433 days Kanawha = 75,190 days Randolph = 11,620 days Webster = 3,485 Days Even if divided by 12 no inmates period of incarceration would equate to those calculations. So using this calculation every inmate would be under the pro rata calculation and equate to all inmates being billed at the $43.58 rate ($54.48*80%). Which is $11 a day lower than the actual per diem costs to the jail. There is a concern that this type of calculation would require at least one to two additional staff at each jail as well as additional staff at the Division of Administrative Services to keep up with the daily changes that would be required to keep this up to date and accurate
