Effect this measure will have on costs and revenues of state government.


There is no way to estimate the financial impact of this proposed legislation, as it is written. There would be a cost related to sampling and cataloging the coal samples, as well as a cost of storing these samples and testing them against current production. In addition, there are financial implications due to the impact of coal production on the waters of the United States and discharges into the Air. The coal production is governed by the Federal Office of Surface Mining and the water and air impacts are governed by the Federal Environmental Protection Agency. Anything that would fall out of either of these agencies' jurisdictions could prevent West Virginia from receiving federal funding from them.

Memorandum


The bill does not specify what types of test would be run on the samples, how they would be maintained, what would cause coal production to be compared to the sample being maintained. There is no mechanism to determine authority or use. There is no authority to develop rules. There would have to be a mechanism to determine the criteria for intrastate; especially related to operations on the borders of the State. Federal dollars from multiple Federal agencies could be jeopardized if this legislation was passed.
