The proposed legislation provides for the Commissioner of the Division of Highways to allow an increase in gross weight limitations on certain roads in Greenbrier County. The legislation only identifies County Route 10/1 from milepost 6.10 to 11.60 and states a permit fee of $500 would be required for each vehicle. The cost to the Division of Highways associated with the legislation in consideration of the permit fee is estimated to be a net of zero costs. This is estimated based on the WVDOH simply administering the permit transaction and any improvement costs or on-going maintenance costs necessary for the particular section of highway referenced in the legislation would be borne by others, not the Division of Highways.

Memorandum


The section of County Route 10/1 referenced in the legislation is under the jurisdiction of the West Virginia Department of Transportation, Division of Highways (WVDOH). Please note this particular section of highway has also been included in the Coal Resource Transportation System (CRTS) and there is an existing agreement in place with a private company which outlines responsibilities for maintaining this section of highway while it is part of the CRTS. Also, the agreement specifies size and weight limitations that are allowed for County Route 10/1 between milepost 6.10 and 11.60. There could be a potential conflict with the permit holder not being the same as the private company currently responsible for maintaining that section of highway as part of the CRTS. It is suggested potential conflicts with the existing agreement as part of the CRTS program be further reviewed and, if necessary, resolved. In particular the maintenance requirements of the section of the road. The proposed does not clearly provide for any limitations on size and weight limitations nor whether the use of “off-road” vehicles will be traveling along this section of highway. It is suggested this legislation be further reviewed for any potential conflicts with existing legislation such as requirements for vehicles traveling on a West Virginia highway is required to have in place. The legislation is not clear on how the maintenance of that particular section of highway will be handled. It states that the Commissioner would need to determine that portion of the highway is designed to allow the gross vehicle weight and dimensional limitation to be increased without damage. However, without having any vehicle size and weight limitations, on-going maintenance will most likely be required. This would include simple maintenance such as road sweeping/dust control to potentially major reconstruction. It is assumed routine maintenance such as mowing and snow removal and ice control would continue to be performed by the WVDOH. Based on the permit fee of $500 and the assumption that any necessary highway improvements and/or subsequent maintenance would be borne by the permit holder(s), the WVDOH would essentially be administering a permit process at a net cost/revenue of zero
