Fiscal Note Summary
Effect this measure will have on costs and revenues of state government.
The West Virginia Division of Corrections is unable to estimate how many new offenders would be sentenced to our custody as a result of the proposed legislation. However, for each such offender incarcerated, the State of West Virginia can expect an additional cost of $27,684 per year (average annual cost per offender in FY 2016).
The current sentence for 2nd degree murder is a determinate term of no less than 10 and no more than 40. However unlike other determinate terms in statute 2nd degree murder requires the offender to serve 10 years prior to parole eligibility (normally 1/4 of the sentence imposed. Therefore the minimum term an offender can serve for 2nd degree murder is 5 years (day for day good time applied to a minimum sentence of 10 years).
