Effect this measure will have on costs and revenues of state government.
The proposed legislation will not have a significant fiscal impact on the WVDOC due to the proposed legislation not affecting the minimum sentence for offenders of this type of offense. Any impact would be felt for those offenders incarcerated after the fifth year due to the increase in the maximum sentence. We are unable to predict how many offenders this would impact. However, for each offender that would be affected for this type of offense it would cost the State of West Virginia $26,081 each year (the average cost per offender).
