Effect this measure will have on costs and revenues of state government.


The proposed legislation will not have a significant impact on the WV Division of Corrections due to the proposed legislation not affecting the minimum sentencing for offenders with this type of offense. Any impact would be felt for those offenders incarcerated after the fifth year due to the increase in maximum sentence. We are unable to predict how many offenders this would impact. However, for each offender that would be affected for this type of offense it would cost the State of West Virginia $26, 081 per offender each year (the average cost per offender Fiscal Year 2017).
