House Bill 4203, if enacted, would create the Campus Free Speech Act as well as the Committee on Free Expression. The proposed legislation requires the Higher Education Policy Commission to develop and adopt a policy on free expression. The legislation requires The Committee on Free Expression to report to the public, the Higher Education Policy Commission, the Governor, and the Legislature by September 1 of every year. The bill requires the report to include the following information: (1)A description of any barriers to or disruptions of free expression within the state institutions of higher learning. (2)A description of the administrative handling and discipline relating to these disruptions or barriers. (3)A description of substantial difficulties, controversies, or successes in maintaining a posture of administrative and institutional neutrality with regard to political or social issues. (4)Any assessments, criticisms, commendations, or recommendations the committee sees fit to include. The legislation also requires all public institutions to include in freshman orientation programs a section describing the policies regarding free expression. Although these requirements would increase the administrative workload at the colleges and universities, it is anticipated that additional costs associated with the legislation would be absorbed by the institutions and the Commission. Significant expenditures may be incurred on a periodic basis as a result of this legislation; however, it is not possible to predict the magnitude or frequency of these costs. As a result, no additional state appropriations are requested.
