Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to add grievance and appellate procedures and judicial review for participants in the Department of Health and Human Resources’ safety and treatment program. The bill also authorizes the Secretary of the Department of Health and Human Resources to promulgate a rule(s) to add such procedures and review for participants of the safety and treatment program.
The Department does not anticipate a significant financial impact based on this legislation. Based on experience within the program, it is anticipated that there is potential for no more than three occurrences per year of review of participants outcome. The development of an additional administrative process will increase the workload for current staff and potentially require additional costs pending the results of the final developed procedure, but these additions could be covered by current staff and existing program revenues.
