Effect this measure will have on costs and revenues of state government.
Each offender sentenced under the proposed legislation that would receive an additional 5 year to the minimum of their determinate sentence would result in an additional cost to the WV Division of Corrections of $130,405 per offender ($26, 081 average annual cost per offender in FY 2017 multiplied by 5 years).
An example for those offenders with indeterminate sentences that would have the minimum sentence doubled as a result of the proposed legislation would be as follows: an offender sentenced for a 2yr – 10yr sentence would have the minimum 2yr sentence doubled to 4yrs which would result in an estimated $52,162 ($26, 081 average annual cost per offender in FY 2017 multiplied by 2 years) However, the West Virginia Division of Corrections is unable to estimate how many new offenders would be affected by these enhanced minimum sentences.
