The WV Division of Corrections & Rehabilitation cannot determine how many offenders with 2 prior felony convictions receive probation sentences (probation is supervised by the WV Supreme Court). However, for each offender that has 2 prior felony convictions that would have received a probation sentence that is instead sentenced to prison terms as a result of this bill, the State of West Virginia can expect a fiscal impact of $25,879 per year they are incarcerated (average annual cost per year in FY2018).
