Effect this measure will have on costs and revenues of state government.
History -- During the 2018 Regular Legislative Session, the Legislature adopted Senate Bill 625: the West Virginia Fire, EMS, and Law-Enforcement Officer Benefit Act. This Act provided a death benefit for emergency responders whose death occurs in the line-of-duty. In June, the Legislature amended the Act to make it retroactive and applicable to the incident that claimed the life of two volunteer firemen from the Pratt VFD who lost their lives in a tragic accident responding to a call. Current language in this Act is vague as it relates to the Division of Forestry and its personnel.
The purpose of this bill is to include Division of Forestry employees eligible for survivor benefits as all other first responders if they are killed while engaging in wildland firefighting or emergency/disaster response.
This an Interim Committee bill recommended for introduction and passage by the Forest Management Review Commission.

Explanation of above estimates (including long-range effect):
It is not possible to estimate the cost of this legislation; however, representatives from the Division of Forestry familiar with the Division's history believes that there have not been any duty-related deaths involving its personnel since the creation of the agency.
Memorandum
The Division strives to maintain work environments that are as safe as possible and we are remain hopeful that this survivor benefit never applies to one of our employees.
