Fiscal Note Summary


Effect this measure will have on costs and revenues of state government.


The purpose of this bill is to create the Nondiscrimination in Involuntary Denial of Treatment Act. The proposed legislation will require the Department to develop and maintain a registry that lists the identity and contact information for organizations inside and outside of West Virginia that have voluntarily notified the Department that they may provide information and assistance to patients and persons legally authorized to make health care decisions on behalf of patients in cases in which a patient's health care provider may be unwilling to comply with patient's or surrogate's wishes regarding the provision, withholding, or withdrawal of life-sustaining medical treatment. Should this proposed legislation pass and its requirements fall under the authority of the Bureau for Public Health, a new position (HHR Specialist) will be needed to develop and maintain the registry. The Department estimates the cost for this legislation to be $70,782 for FY2020 and $69,282 going forward. The Department assumes that if the proposed legislation passes, it will have an effective date of July 1, 2019.

Explanation of above estimates (including long-range effect):


Estimated Personal Services for FY2020 and ongoing is $58,482 for a Health and Human Resources Specialist to work with the Department's Management Information Services (MIS) to develop a registry and update it as new information is available. Included in this estimated Personal Services cost is the salary for a 1.00 FTE HHR Specialist ($39,522) and Fringes and Benefits in the amount of $18,960. Fringes and Benefits include Public Employees Health Insurance Administrative Fees of $50 ($50 per employee x 1 FTE); Personnel Administrative Fee of $180 ($180 per FTE x 1 FTE); Health Insurance of $9,456 ($9,456 per FTE x 1 FTE); Social Security of $3,023 ($39,522 x .0765); Retirement of $3,952 ($39,522 x .10); Workers Compensation of $103 ($39,522 x .00261); and WV OPEB Contribution of $2,196 ($2,196 per FTE x 1 FTE). The estimated Current Expenses for FY2020 and ongoing is $10,800 and include landline telephone service of $600 ($50 per month x 12 months x 1.00 FTE); office supplies of $200 ($200 per FTE x 1.00 FTE);and MIS support costs of $10,000. One time current expense costs of $1,500 include computer equipment of $1,000 ($1,000 x 1.00 FTE);and a network printer of $500.

MIS costs associated with developing and maintaining the registry will be done with existing staff with no additional costs.
