Fiscal Note Summary

Effect this measure will have on costs and revenues of state government.

The purpose of this bill is to create the Nondiscrimination in Involuntary Denial of Treatment Act.
The proposed legislation will require the Department to develop and maintain a registry that lists the identity and contact information for organizations inside and outside of West Virginia that have voluntarily notified the Department that they may provide information and assistance to patients and persons legally authorized to make health care decisions on behalf of patients in cases in which a patient's health care provider may be unwilling to comply with patient's or surrogate's wishes regarding the provision, withholding, or withdrawal of life-sustaining medical treatment. Should this proposed legislation pass and its requirements fall under the authority of the Bureau for Public Health, a new position (HHR Specialist) will be needed to develop and maintain the registry.
The Department estimates the cost for this legislation to be $70,782 for FY2020 and $69,282 going forward.
The Department assumes that if the proposed legislation passes, it will have an effective date of July 1, 2019.
