The purpose of this bill is to limit the civil penalty for persons convicted of littering to an amount up to $2,000.
Currently, magistrate court clerks remit 50% of the civil penalty to the Treasurer for deposit into the Litter Control Fund and remit the other 50% to the county or regional solid waste authority in the county in which the violation occurred. By changing the civil penalty from a set amount of $2,000 to an amount up to $2,000, the amounts collected will be less. With the civil penalty being in the discretion of the magistrate, there is no way to estimate the reduction.
