Effect this measure will have on costs and revenues of state government.


As of the end of FY2018, there were 116 offenders incarcerated in the WV Division of Corrections & Rehabilitation, whose most serious crime was Abuse/Neglect of a Child that caused Injury, Serious Injury, or created the Risk of Serious Injury or Death. The proposed bill seeks to increase the penalties for these types of offenses and any subsequent convictions for these types of offenses. It is difficult to determine how many of the 116 offenders had prior convictions for these offenses, or which section of the proposed code would be used for subsequent convictions. However, if future offenders would on average spend at least one additional year incarcerated compared to current offenders the State of West Virginia could expect a cost of $3,001,964 (116 x average annual cost per offender in FY2018 - $25,879). If half of the 116, would have spent an additional year incarcerated the cost would be $1,500,982.
