It is unknown how many additional offenders would be sentenced to WV Division of Corrections & Rehabilitation custody as the result of this legislation. However, for each additional offender sentenced the State of West Virginia can expect a cost of $25,879 per year (average annual cost per inmate in FY2018).

Memorandum


The prison term of "not less than one year" does not have a maximum and could allow judges to pick high numbers perhaps not intended by the legislation.
