HB 4578, if passed, would require significant additional appropriations to the Attorney General’s Office to meet the new obligations under this bill. (This bill provides no revenue source to fund the bill’s obligations.) The investigative requirements and consequential court actions would require additional personnel and related assets. Several factors affecting the cost calculations are presently unknowable, which complicates the development of long-term cost estimates.

Explanation of above estimates (including long-range effect):


There is ample uncertainty regarding many factors affecting the cost of implementing HB 4578, including but not limited to the number of complaints, the number and duration of investigations (required and discretionary), and the number of actions filed after completed investigations. Given these uncertainties, certain assumptions have been made in order to provide these estimates. Further, it should be noted that, as a result of the methodology implicit in these assumptions, the estimates provided should be considered generally as the minimal amounts necessary to meet the obligations of this bill. The current estimates are based on the following: Adding sufficient investigative personnel to meet conservative estimates of anticipated complaints and office personnel to meet anticipated amounts of required court actions, report monitoring and retention, and other related obligations under HB 4578. (7 FTEs amounting to $450,000 in salaries and benefits.) Adding physical assets and expenses to support work for investigative and office personnel commensurate with their duties. (First-year costs of $130,000; second-year onward costs of at least $30,000/year.) Further, the above estimates do not reflect replacement cost of automobiles or additional physical space. If additional physical space is needed, the estimates above would increase.



Memorandum


The U.S. Department of Labor (“U.S. DOL”) currently conducts workplace investigations examining various issues, including employee immigration status. Memoranda of Understanding (MOUs) with U.S. DOL and other agencies would be necessary to conduct the investigations contemplated by this bill. The article number used by HB 4578 (i.e. Article 1C of Chapter 21) is already in use. (Article 1C of Chapter 21 is presently the WV Jobs Act.)
