Effect this measure will have on costs and revenues of state government.
The purpose of this bill is to allow the Department of Health and Human Resources to pay for tubal ligation without requiring at least 30 days between the date of informed consent and the date of sterilization so that tubal ligation can be performed at the time of delivery.
The Centers for Medicare and Medicaid Services (CMS) sterilization consent rules require a minimum 30-day waiting period to get individuals’ written informed consent prior to sterilization. If the waiting period is eliminated, the cost for those services provided without a 30-day waiting period would shift to the state. The Department estimates the fiscal impact of this legislation is $21,640 in first year and ongoing.

Explanation of above estimates (including long-range effect):
The Department paid approximately 224 claims in the past year for tubal ligation services, totaling $46,040 ($11,940 state dollars). Based upon a recently published article by the Kaiser Family Foundation, eliminating the 30 day waiting period between the date of informed consent and the date of sterilization could increase tubal ligations by an estimated 47%.
Projected increase to current cost would be $21,640 ($46,040 x .47). As CMS sterilization consent rules require a minimum 30-day waiting period to get individuals’ written informed consent prior to sterilization, eliminating the 30 day waiting period for tubal ligation services would shift total increased cost to the state.
