Delegate Marcum Introduces Bill to Increase Penalties for Embezzlement in Education

Charleston W.Va – Delegate Justin Marcum, D – Mingo, has introduced and is lead sponsor of a bill that would increase the penalties of being convicted of embezzlement of school funds from 1-10 years to 3-15 years of incarceration and a fine of up to $25,000 dollars.

Delegate Marcum said that the bill’s draft is in response to allegations of embezzlement in the southern counties of West Virginia. The bill has bipartisan support across the House of Delegates.

“Children are our most precious resource and those who try to steal from them are going to have a bad day in West Virginia,” said Delegate Marcum. “I am proud to fight against corruption and it must be eliminated, especially if it is in our school system.”

The bill would apply to any officer, agent, clerk or servant of any school district convicted under this section of the code would receive the increased penalties.

Delegate Marcum said he hopes to that the cracking down on embezzlement that the bill does, will eliminate the “Buddy System” that can take place in the education system. He said that the State Police he has talked to and the State Auditor are all in on supporting the enforcement of this legislation.
