A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §9-5-25, relating to requiring West Virginia Bureau for Medical Services to enter into a compact with surrounding states to ensure providers receive payment for Medicaid services.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, be amended by adding thereto a new section, designated §9-5-25, to read as follows:

ARTICLE 5. MISCELLANEOUS PROVISIONS.


§9-5-25. Medicaid program compact.

(a) The Secretary of the Department of Health and Human Resources shall contact West Virginia’s surrounding states to discuss the creation of a compact.  This compact would enable each states’ health care providers to be eligible to be paid for services provided to the other states’ Medicaid participants.

(b) The Secretary shall provide a report on the creation of a Medicaid compact to the Legislative Oversight Commission on Health and Human Resources Accountability before October 31, 2017.

 

NOTE: The purpose of this bill is to require the Department of Health and Human Resources to enter into a compact to ensure payment for health care services provided to other states’ Medicaid participants.
