A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §7-1-3tt, relating to authorizing county commissions to add a surcharge to county property tax bill of all residential property owners for the service of trash collection; and limiting disbursement of moneys collected.

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §7-1-3tt, to read as follows:

ARTICLE 1.  COUNTY COMMISSIONS GENERALLY.

§7-1-3tt.  Authority to impose surcharge for trash collection.


(a) The county commission in any county is authorized to impose a surcharge on the annual property tax bill of all residential property owners for trash collection.

(b) For purposes of this section, “residential property” includes all property upon which a dwelling is located, including rental units.

(c) The county surcharge for trash collection shall be imposed on each dwelling owned on July 1 of each year and, if more than one unit in a dwelling, on each unit in the dwelling.  Further, the county surcharge shall be imposed whether the dwelling or unit is occupied or vacant.

(d) The money collected under this section shall be deposited into a special county fund to be used in the county, exclusively, to support waste management efforts.  The county commission, in consultation with the county solid waste authority, shall determine how to disperse the money in the county where it was collected.

NOTE: The purpose of this bill is to authorize county commissions to impose a surcharge on residential property owners for trash collection and provide for disbursement of money collected.
