A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §33-16-12a, relating to certain allergy medication; requiring insurance policies issued in the state to cover the cost of certain injectable allergy medication for those 18 years of age or younger.

Be it enacted by the Legislature of West Virginia:


ARTICLE 16. GROUP ACCIDENT AND SICKNESS INSURANCE.


§33-16-12a. Injectable allergy medication covered for those age 18 and younger.

All policies issued pursuant to this article shall cover the complete cost of prefilled epinephrine injectors, such as Epipen or generic medical equivalent, approved by the United States Food and Drug Administration, at no cost to children 18 years of age or younger, who are considered by a health care provider to be at risk for severe allergic reaction. Policies shall provide for prompt refilling of prescriptions to replace injectors approaching expiration date.

 

NOTE: The purpose of this bill is to require that insurance policies in the state provide, at no cost, emergency medication in the form of injectable epinephrine prescribed for those 18 years of age or younger, who are at risk of severe allergic reaction.
