A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §5F-1-2a, relating to requiring cabinet secretaries to review all rules under their jurisdiction similar to federal rules where state rules are more stringent than federal rules; and requiring reporting to the Joint Committee on Government and Finance within one year.   

Be it enacted by the Legislature of West Virginia:


That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §5F-1-2a, to read as follows:

 ARTICLE 1.  GENERAL PROVISIONS.

§5F-1-2a.  Cabinet secretaries required to review rules and report to Joint Committee on Government and Finance within one year of effective date.


Each department secretary as identified in section two of this article shall review all rules under the secretary's jurisdiction which are similar to federal rules and report to the Joint Committee on Government and Finance those state rules which are more stringent than the similar federal rules and the substance of the state's more stringent provisions.  The secretary shall submit the report within one year of the effective date of this section.

NOTE: The purpose of this bill is to require cabinet secretaries to report to the Joint Committee on Government and Finance state rules that are more stringent than similar federal rules. The reports are to be submitted within one year of the effective date of the legislation.
