A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §15A-5-10, relating to the waiver of all penalties, costs, assessments, forfeitures, fines, and fees associated with criminal convictions for persons who successfully complete the Getting Over Addicted Lifestyles Successfully Program in jail for the purpose of obtaining a driver’s license.

Be it enacted by the Legislature of West Virginia:


ARTICLE 5. Bureau of Prisons and Jails.

 §15A-5-10. Waiver of fines and fees for successfully completing the GOALS Program.

Notwithstanding any provision of this code to the contrary, any individual committed to the custody of the Commissioner of the Division of Corrections and Rehabilitation who successfully completes the Getting Over Addictive Lifestyles Successfully Program shall have all penalties, costs, assessments, forfeitures, fines, and fees associated with his or her criminal convictions waived for the purposes of obtaining a driver’s license.  The provisions of this waiver do not apply to any restitution owed. Unpaid restitution shall not be a bar to the issuance or reissuance of the individual’s driver’s license.

 

NOTE: The purpose of this bill is to remove the obstacles for obtaining a driver’s license by waiving all penalties, costs, assessments, forfeitures, fines, and fees associated with his or her criminal convictions for persons who successfully complete the Getting Over Addicted Lifestyles Successfully Program.
