A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §8-14-17a, relating to transferability for certified law-enforcement officers from one department to another throughout the state; civil service status; and benefits.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §8-14-17a, to read as follows:
ARTICLE 14. LAW AND ORDER; POLICE FORCE OR DEPARTMENTS; POWERS, AUTHORITY AND DUTIES OF LAW-ENFORCEMENT OFFICIALS AND POLICEMEN; POLICE MATRONS; SPECIAL SCHOOL ZONE AND PARKING LOT OR PARKING BUILDING POLICE OFFICERS; CIVIL SERVICE FOR CERTAIN POLICE DEPARTMENTS.

§8-14-17a. Transferability of certified law-enforcement officers in law-enforcement departments throughout the state.

Notwithstanding any provision in this article to the contrary, in all Class I and Class II municipalities throughout the state that have a paid police department under a civil service commission in accordance with section seven of this article, certified law-enforcement officers applying for positions in other departments may transfer to them and retain the same civil service status attained in their former department regarding rank, pay grade, seniority, pension and all other benefits.



NOTE: The purpose of this bill is to allow certified law-enforcement officers to transfer to other departments in the state and retain all civil service status from the previous department in which they were employed.
