A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §10-1-23, relating to transferring the assets of the Library Commission relating to media broadcasting to the Educational Broadcasting Authority.

Be it enacted by the Legislature of West Virginia:

That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §10-1-23, to read as follows:

ARTICLE 1. PUBLIC LIBRARIES.

§10-1-23. Library Commission’s media broadcasting assets transferred to the Educational Broadcasting Authority.

All assets of the Library Commission relating to media broadcasting are transferred from the Library Commission to the Educational Broadcasting Authority unless to do so would violate federal law or an agreement with an entity that supplied funds to acquire a specific asset.  If the Library Commission and the Educational Broadcasting Authority do not agree on whether a specific asset relates to media broadcasting, the Governor shall make the determination. The Governor shall ensure that the assets are transferred within sixty days after the effective date of this section.

NOTE: The purpose of this bill is to transfer the assets of the Library Commission relating to media broadcasting to the Educational Broadcasting Authority.
